Chapter 13 Clients

Please use this page as a guideline as you prepare to file a Chapter 13 petition.  Remember we need all required documents, bankruptcy fee, and your credit counseling certificate in order to file your petition.

Steps:

  1. Pull together documents and $750 retainer fee.  You have not “retained” Simon Haysom as your attorney until the $750 retainer fee is paid
  2. Set up a forms appointment with our Chapter 13 paralegal to go through your documents.  Remember the paralegal is not an attorney and cannot answer your legal questions.  All legal questions should be directed to the attorney.
  3. Assemble the rest of your documents and the remainder of bankruptcy fee.  The timing of this step is entirely up to you.
  4. Complete your credit counseling when you are ready to pay for your bankruptcy in full.  Your credit counseling certificate expires six months after you receive it, so keep that in mind as you schedule your counseling session.
  5. Our office will complete your petition once all documents are in our office, and the bankruptcy is paid in full.  It generally takes us two to four weeks to complete the paperwork.
  6. Simon reviews the petition carefully for legal issues and signs the document
  7. We will call you when the petition is completed and signed to set up an appointment.  You will come in to the office to review and sign the petition.
  8. The petition is filed electronically.  We will call you with your case number once we have it.
